I've been reading post and I'm glad to hear that it all worked out for you.
No. I was paid for the use of my paintings for the album and promotional use, any merchandising was to be a separate contract but Train's management at the time made and started selling merchandise before any contract was even written and Sony was upset too but because they paid me for the album art for promotional use and Train used my work without my permission it falls on them. Train and I mean their management Bill Graham productions at the time never paid for the rights to use my work for merchandising. The issue has been past from new management to new management for 10 years so thats one reason and the other is I'm not big on suing but this post got a response from Crush management Trains current rep Jon Lullo contacted me this morning and we will talk monday. I talked with him before when they asked me to do the wine label but as I'm am a fine artist not a graphic artist I was not able to help. I also asked about the merchandising at that time and he sidestepped the issue just as the others had done so maybe now I can get this resolved.
